When you ("You" or "User") use this Internet web site ("Site"), You agree to the following terms and conditions (the "User Agreement"). Festival Monster. ("Festival Monster" or "We") may revise these terms from time to time, at our sole discretion, by updating this posting. Unless otherwise provided below, the revised terms will take effect when they are posted. BY CONTINUING TO USE THE SITE, YOU ARE INDICATING YOUR AGREEMENT TO THE TERMS OF THIS USER AGREEMENT AND ALL REVISIONS THEREOF.
Each individual may sign up only once for an account. If for any reason your membership is terminated by Festival Monster, you may not sign up again.
A user may remove their account at any time by deleting your account from within Festival Monster, simply navigate to your control panel area and choose the appropriate action.
You must be 13 years old or older to become a user:
Festival Monster reserves the right to remove any user or any user submitted content at any time without prior written notification.
Festival Monster retains all rights to the Festival Monster business name, site logo, databases, web site, and all information concerning Festival Monster. No part of the Festival Monster web site may be reproduced in any way without the written consent of Festival Monster. This excludes ALL user submitted content, you as the user retain full copyright for all of your own content and maintain all of the usual rights and reserves for your work.
Festival Monster, its managers, partners, and or sponsors can not be held liable for any damage or loss of information that may occur from the use of Festival Monster services.
All Members agree to use our services at their own risk.
It is each Members responsibility to ensure that their contact details remain up to date and accurate.
It is each Members own responsibility to ensure the content they upload is theirs to display legally. Festival Monster accepts no responsibility for the misuse of its services in this manner.
Festival Monster will make every effort to verify and maintain a high standard of quality service. As with any service, there are no guarantees regarding the dependency or accuracy of said service.
Festival Monster accepts no responsibility for the content uploaded by the sites users, we reserve the right to remove or censor offensive, illegal or inappropriate material. If you discover such content please report them to us via abuse@Festival Monster.com.
Festival Monster accepts no responsibility for the content and quality of external websites which may be linked to from this site. These include advertising links, users links and any other link that points to a site not owned or controlled by Festival Monster.
All terms of this agreement are subject to change at any time without the prior notification or approval of the users. It is your responsibility as a user to stay current with changes made in our policies.
Festival Monster hope to continually add new features and areas to the service offered but as with any service this may mean the removal of other features deemed necessary to ensure growth and stability throughout.
By joining Festival Monster, you are agreeing to these Terms & Conditions that we have posted on our Web Site for all to read. Please do not join Festival Monster if you do not agree with ALL of our Polices.
Shop - Selling
If you setup a shop on the Festival Monster website you agree to these additional terms and conditions:
You may only run one shop on the Festival Monster site, if you are found to be running multiple shops or continuing to run a shop after you have been banned then you will have the shop deleted and any funds you have earnt will be confiscated and your account deleted.
Setting up a shop is free and there are no monthly fees. There is however a 20% commission taken from every transaction that occurs. The commission is taken away from the transaction total before the amount is credited to your account. This commission fee is subject to change at any time at our discretion.
The maximum amount that can be sold per transaction is £25.00 and the minimum is £2.00. This means you cannot list items for sale that are below the minimum price or above the maximum price. Please also bear in mind that this transaction limit includes the cost of postage.
Upon selling an item you will receive an email notification. The email will not contain any details about the transaction. It is your responsibility to login to your Festival Monster account to view the transaction details, we will never email such details to you.
Once the buyer has paid for an item, the funds (minus the 20% Festival Monster commission) will be held in escrow until the buyer either marks the item as received or 7 days 0 hours pass without the buyer notifying Festival Monster of a problem with the transaction. Please note, this time period is subject to change at anytime without advanced notice.
In the event of a problem with the transaction, Festival Monster will freeze the payment until a resolution between buyer and seller is found. Festival Monster requires sellers to keep proof of postage of all items otherwise we will have no choice but to refund the monies to the buyer in the event that the item is marked as unreceived.
Funds that have been credited to your account may be used to pay for future purchases or, you can request a withdrawal once your account has over £10.00. You can request a withdrawal from your accounts page, we will then check the details and send you a cheque to your shop address. You can check the status of a withdrawal from your transactions page.
You may only list items in your shop that are actually in your possession and that you legally own or have rights to sell. You may not sell anything that is illegal to sell or own in the UK. You may also only sell items that can legally be purchased by people aged 13 or over, you are not allowed to sell any age restricted items through the Festival Monster website.
If you are selling songs through Festival Monster then you must be the legal copyright holder of the music you are selling. Songs can cost 1 or 2 credits and as with the shop Festival Monster takes a 20% commission from each transaction.
It is your responsibility to accurately list and describe the items you are selling, it is also your responsibility to ensure all prices and postage costs are correct and that you keep the stock figures up to date.
Failure to adhere to any of the selling rules can lead to your account being deleted and any funds being frozen.
Shop - Buying
If you use the Festival Monster website to buy items or songs from any other members then you agree to the following terms and conditions.
Festival Monster acts as an agent in all transactions and as such accepts no legal responsibility for the transaction itself. All responsibility rests with the seller and you are purchasing directly from the seller. It is entirely up to your own judgement whether to trust a seller or not, Festival Monster accepts no responsibility for misrepresented items or any other problems occuring during a transaction.
It is a buyers responsibility to mark an item as received or to report a problem to Festival Monster promptly. We will only transfer payment into a sellers account after the buyer marks it as received or 7 days 0 hours pass without the buyer notifying Festival Monster of a problem with the transaction. Please note, this time period is subject to change at anytime without advanced notice.
If the item arrives damaged, doesn't arrive at all or isn't what you were expecting then you need to contact the seller and rectify the problem directly with them. Festival Monster accepts no liability for any problems occuring during a transaction or for any problems with the items being brought or sold.
We cannot stress enough that you are buying directly from sellers on the Festival Monster website. Festival Monster only provide the space to advertise such items and process the payments between buyer and seller, we take no active role in the transaction itself.
In the event of a problem with any seller you agree to persue the problem directly with the seller and release Festival Monster and all of its partners, directors, employees and other operatives from all claims, damages, losses and liabilities conencted with the transaction problem.
You accept that Festival Monster does not control the information sellers list. As such you accept that you enter any transaction at your own risk, you may be dealing with people acting under false pretences or listing items incorrectly. We do not allow illegal items to be sold but it is the buyers responsibility to monitor for such items and to nofify Festival Monster upon discovering such an item.
As a buyer you have a legal responsibility to complete any transactions you enter into with a seller. By purchasing an item through the Festival Monster website you agree to be bound by these terms and conditions and accept that these may change at anytime.
Liability
Festival Monster do not gurantee the service we provide in any way, the operation of the website including its database may be interfered with by factors outside of our control. The website and its services are provided "as is", we accept no responsibility for any economic losses, losses of goodwill and reputation or any other damages resulting from your use of the Festival Monster website.
